END USER LICENSE AGREEMENT (EULA)

1. Introduction

Hey, I’m Viktor Nübel, operating under the name Viktor Nübel Type Design. I own the fonts delivered with this license. In this document, those fonts — together with any documentation and updates — are called the “Font Software”.

This End User License Agreement (“Agreement”) is a contract between you and me. “You” or “Licensee” means the person or entity that bought this license. This license is non-exclusive and non-transferable and applies to any updates I provide.

By downloading, installing, accessing, or using the Font Software, you agree to these terms. If you do not agree, do not download, install, access, or use the Font Software.

2. Ownership and Intellectual Property

All rights, title, and interest in and to the Font Software, including all intellectual property rights, remain the exclusive property of Viktor Nübel Type Design and the designer Viktor Nübel. This Agreement does not transfer any ownership rights to you.

3. Types of Use

By selecting and purchasing a license model and concluding the corresponding agreement with me, you acquire the right to one or more of the following types of use:

3.1 Desktop License

You may install the provided Font Software on the agreed number of computers or devices and use it to create printed documents, static images, animated graphics, visual identities, books, and similar works. You may convert the typeface design into outlines and modify those outlines, for example to create logos. You may also embed the Font Software in static documents such as PDFs.

The scope of use of the Font Software is limited to the number of authorized users agreed in the order or invoice, regardless of how many computers the authorized users use the Font Software on. If the actual number of users exceeds the agreed number, you must purchase one or more additional Desktop Licenses.

3.2 Web License

You may use the provided Font Software to embed the typeface design in websites using @font-face and make it publicly available.

A web license applies to one domain or, if more are agreed, to the number of domains specified in the order or invoice. The number of page views is not limited. If the Font Software is to be used on additional domains or websites, you must purchase one or more additional Web Licenses.

Only the WOFF or WOFF2 files provided are permitted for embedding via @font-face. The use of OTF or TTF files or their conversion for web embedding is prohibited. For any type of use, you must ensure that the Font Software cannot be referenced and used by other websites (“hotlinking”).

3.3 E-Book License

You may use the provided Font Software to embed the typeface design in e-books and make them publicly available.

An E-Book License applies to one e-book title, including updated, revised, or alternative-format versions, provided that the original content has not changed significantly. A separate E-Book License is required for each additional title.

3.4 App License

You may use the provided Font Software to embed the typeface design in apps and make it publicly available.

An app license applies to one app title and includes its updates, regionally adapted, or new version variants, provided that the content and functionality of the original app have not changed significantly. The scope of use of the Font Software is limited to the maximum number of app downloads or installations agreed in the order or invoice. If the actual number of downloads or installations exceeds this number, or if the Font Software is to be used in additional apps, you must purchase one or more additional app licenses.

3.5 Trial Fonts

From time to time I may make trial versions of the Font Software available free of charge or on a time-limited basis for evaluation purposes (“Trial Fonts”). Trial Fonts may include limited glyphs, restricted OpenType features, embedded watermarks, or other technical limitations.

Trial Fonts may be installed and used solely for internal evaluation and testing before purchasing a commercial license. They may not be used for commercial, public-facing, or client-facing purposes.

If you are actively enrolled as a student at an accredited educational institution, you may use Trial Fonts in final files for strictly non-commercial and educational purposes only. Use in portfolios, client projects, or any other commercial context is not permitted.

You may not subset Trial Fonts, or remove or circumvent any embedded watermarks, character set limitations, or other technical restrictions. If a Trial Font is provided for a limited time period, you must cease all use and delete all copies upon expiry; continued use of a Trial Font beyond evaluation requires purchase of the appropriate commercial license and constitutes a material breach of this Agreement.

4. Authorized Users, Contractors, and Service Providers

The humans designated by you to use the Font Software are authorized users. They may be employees or independent contractors providing professional services for you.

If you are a design consultancy, advertising agency, or purchasing this license for use by or on behalf of another entity, the ultimate end user must also purchase a license appropriate for their intended use of the Font Software.

You may make the Font Software available to authorized users who are providing professional services expressly for your benefit, provided that they agree to use the Font Software exclusively for work on your behalf, comply with this Agreement, and destroy all copies of the Font Software and its documentation upon completion of the work. Such users may not use the Font Software for any other projects or clients without purchasing their own license.

If providing a print-ready PDF is not possible, you may provide the Font Software to a commercial printer or service bureau solely to perform work on your behalf, provided that all copies are destroyed upon completion.

5. Restrictions

Whenever this Agreement permits embedding, you must securely embed the Font Software so that unlicensed third parties cannot access or extract it.

You may not:

  • Modify, adapt, translate, reverse engineer, decompile, disassemble, dismantle, or otherwise attempt to determine the source code of the Font Software, or create derivative works from it.
  • Transfer, assign, sell, rent, lease, lend, give, sublicense, distribute, or otherwise make the Font Software, this license, or any associated rights available to unlicensed third parties unless expressly permitted by this Agreement or approved by me in writing.
  • Use the Font Software in a way that allows unlicensed third parties to create new documents using the Font Software (e.g., as a server-side font generation service), unless a custom Server License is obtained.
  • Embed the Font Software in editable documents or templates unless specifically licensed to do so.
  • Release or distribute the Font Software under an open-source, public-domain, or similar license.
  • Use the Font Software, in whole or in part, as input, training data, or reference material for generative artificial intelligence, machine-learning models, or similar automated technologies.
  • Use the Font Software in violation of any applicable laws, including those relating to hate speech, discrimination, or defamation.

6. Warranty

The Font Software is provided “as is.” To the maximum extent permitted by applicable law, I disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by applicable law, my total liability arising out of or in connection with this Agreement or the Font Software shall not exceed the amount paid by you for the license. I shall not be liable for any indirect, incidental, special, or consequential damages.

7. Legal

This Agreement, together with your invoice and any applicable order confirmation, constitutes the entire agreement between you and me regarding the Font Software and supersedes all prior agreements and understandings.

This Agreement is effective upon purchase or download and continues until terminated. I may terminate this Agreement immediately if you breach any of its terms. Upon termination, you must cease all use of the Font Software and destroy all copies in your possession.

I reserve the right to amend or modify this Agreement. Amendments will be published on my website or communicated to you by email. Continued use of the Font Software after such amendments take effect constitutes acceptance of the modified terms.

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

This Agreement shall be governed by and construed in accordance with the laws of the Federal Republic of Germany. The place of jurisdiction is Berlin, Germany.
